How to Retain

At the bottom of this page are icons which link to downloadable client interview forms.  Which one is appropriate for you depends on whether or not a case or court order already exists.  To select a form, simply right-click on the icon beside it and then save the file to your computer.  You should note that I need the client interview form completed in order to know how to get in touch with you and to understand facts important to your case. The fee agreement serves as a contract between us, determines our obligations to each other, acknowledges what your down payment is and establishes how you may be billed in the future.  I MAY BE RETAINED IN ONE OF THE FOLLOWING WAYS:

IN PERSON:  If you wish to arrange an appointment, contact my staff at (918) 371-1896 to do so.  In that event, you can complete the client interview form and sign the fee agreement in my office at your appointment.  Although the appointment consultation is free, please understand that I do not want you to come in for an appointment until we have had an opportunity to talk on the phone or communicate by e-mail first so that I can understand your situation and you understand my point-of-view on it.  Further, when coming in for an appointment, you are expected to have your retainer in hand.  if you wish to retain me by mail or online, please read the related information below.

ONLINE:  You may retain me online to the extent that you may pay me online and/or e-mail me some of the requested information online.  Retain me online by making payment of your retainer to me via http://www.paypal.com.  You or a third party on your behalf who is making payment must have a PayPal account, which is somewhat simple to set up, and you may pay through a VISA or Mastercard through PayPal.  If you wih to pay by VISA or Mastercard without going through PayPal, simply contact my office and we can conduct the transaction over the telephone.  Direct your payment to jk_mitchell@sbcglobal.net, my registered e-mail there.  Also, you may mail the completed client interview form to my office or e-mail it to jkm@oklahomadivorceattorney.com.  Unless you wish to scan, create, upload and e-mail me the bulleted items listed below in the "By Mail:..." section, you must mail or deliver to me those items separately.

BY MAIL:  Retain me by mail and save some driving and time.  Mail the completed client interview form and agreement to me along with a check or money order in the amount of what is stated for the particular type of action or what I quote you in an e-mail or telephone conversation.  Make your payment to "Joel K. Mitchell, Client Trust Acct."  In addition to enclosing payment, the interview form and signed agreement in the mail, get copies to me of the following documents which I am generally required to disclose to opposing counsel in a domestic case:

  • TAX RETURNS, both federal and state, for the years 2004 and 2005 (if you don't have these documents in your possession, download, print, complete and mail the attached Adobe Acrobat file with the IRS Tax Transcript Request form from this webpage);
  • RECENT PAYSTUBS for the last 60 days for any employer you have;
  • OTHER INCOME DOCUMENTATION, including that relating to a business or to any social security, disability or DHS benefits;
  • TITLES to all automobiles, motorcycles, boats, engines, trailers, etc., on which your name appears;
  • MORTGAGES containing the legal description for any real property on which your name appears, including your home and any rental property or land you own;
  • STATEMENTS for any checking, savings, banking, investment, pension, 401(k), or retirement account on which your name appears; and
  • BILLS, whether recent or not, for any debts which you consider to be marital debt and not your separate property.

Guardianship Interview Form

     You may complete this form and bring it to your appointment or mail/e-mail it to me if retaining me without an appointment in cases that involves initiating a new or terminating an existing guardianship case. Download Guardianship Client Interview Form.doc

Initial Custody or Divorce Interview Form

     You may complete this form and bring it to your appointment or mail/e-mail it to me if retaining me without an appointment in cases that involve the filing of a new divorce, paternity, custody or visitation case where no prior case exists other than a DHS child support case. Post-Divorce/Custody Contempt or Modification Interview Form

     You may complete this form and bring it to your appointment or mail/e-mail it to me if retaining me without an appointment in cases that involves modifying custody, visitation or child support or seeking contempt of court against the other party/parent for denial of visitation or failure to pay child support. Use this form when a district court case (not simply DHS child support case) already exists that gives one parent custody.
